PREAMBLE
1.º These general sales conditions are agreed between DRT RAPID – PROTÓTIPOS E MOLDES, LDA., Headquartered at Rua dos Marinheiros, Lote 6, n.º 146, Zona Industrial da Cova das Faias – Zicofa, 2415-806 Leiria , tax identification number 504 805 657 and contact +351 936 001 973, hereinafter referred to as “DRT RAPID“ and persons who intend to buy on the website https://kyper.drt-group.com/ hereinafter referred to as “User ».
2.º The user who intends to buy on the website https://kyper.drt-group.com/ declares to have full legal capacity.
3.º The parties agree that purchases made on the website https://kyper.drt-group.com/ will be regulated exclusively by this contract excluding any conditions previously available on the website https://kyper.drt-group/.
ARTICLE 1 – OBJECT
1.º The purpose of these general sales conditions is to provide and define all the necessary information to the User on the ordering, sale, payment and delivery modalities of purchases made on the website https://kyper.drt-group.com/.
2.º These conditions regulate all the necessary steps to place the order and guarantee the follow-up of this order between the Contracting Parties.
3.º The user declares to have been aware of the present general sales conditions before ordering and when ordering KYPER face shield(s) on the website https://kyper.drt-group.com/ it is implied the acceptance without reservation by the User and their prior, full and total adherence, to the present general conditions of sale.
4.º DRT RAPID reserves the possibility to change these general sales conditions at any time, and the general sales conditions applicable to any order are those accepted by the User at the time of validating his/her order.
ARTICLE 2 – ORDER
1.º The User places the order by completing the purchase process presented on the website https://kyper.drt-group.com/, adding the desired KYPER face shield to the shopping basket:
2.º To send the order the User must:
- Register on the website https://kyper.drt-group.com/, providing the information requested there. The User is informed and accepts that the introduction of any identification element will prove his identity and express his consent.
- Log in (providing a combination of email and password chosen by the User at the time of registration).
- Complete the information and choose the options available throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the VAT number and name to be included on the invoice, for tax purposes).
3.º The final order confirmation by the User implies the full and complete acceptance of the prices and description of the products available for sale, as well as these General Conditions of Sale, which will be the only ones applicable to the contract thus concluded.
4.º DRT RAPID will honor orders received online only up to the limit of available stocks. If the product is not available, DRT RAPID undertakes to inform the User as soon as possible.
5.º The data contained in the invoice are the sole responsibility of the User. Once the invoice is issued, it cannot be reissued with changes.
6.º The order requests are valid for ten days, unless the order is registered under a promotional campaign that defines a different term and it is not possible to guarantee prices, discounts, promotions and offers beyond this term. If the payment is not received by our services within that period, the order cannot be validated. Any amount received after this date will be returned or used for a new order.
EN_ARTICLE 3 – PAYMENT
1.º After having learned the status of the order, and once the information requested has been provided, the User will choose the payment method for the order.
2.º On the website https://kyper.drt-group.com/, DRT RAPID offers the User the following payment methods via Easypay – Instituição de Pagamento, Lda:
- Credit Card (Visa, Mastercard);
- ATM reference;
- Bank transfer;
- Paypal;
2.º In the case of payment with a credit card, the debit will be made on the User’s card immediately after confirmation of the shipment of the goods. If some products ordered are sold out, the value will be credited to the User’s card, after the order is closed.
ARTICLE 4 – DELIVERY
1.º The delivery of orders takes place up to ten working days after receipt of payment. The company responsible for transportation will be clearly identified at the time of order confirmation.
2.º The shipping costs are added to the order. The amount of shipping costs will be clearly indicated at the time of order confirmation, before payment is made.
ARTICLE 5 – PRICES
1.º The prices must be understood in Euros, with taxes and fees included, taking into account the VAT in force at the time of payment of the order.
2.º If there is an increase in the Price of any product, the User will be informed immediately and will be able to choose to receive the order (by paying the difference) or to proceed with its cancellation.
ARTICLE 6 – CANCELLATION AND RETURN
1.º The cancellation or return process is handled on a case-by-case basis by DRT RAPID. The request must be sent in writing to the email kyper@drt-group.com, within 14 days after receipt of the order. The instructions for cancellation or return of the goods will be answered and defined by DRT RAPID by the same means of Communication.
2.º Whenever possible, the return must be made by the same payment method, but if this is not possible, the user must present proof of payment and account or card ownership, in order to make the return by Bank Transfer.
3.º DRT RAPID undertakes to reimburse the User within a maximum period of 14 days from the date on which it is informed of the User’s decision.
4.º The returned products must be in a perfect condition for sale, that is, in the same condition in which they arrived in the hands of the User, without any anomaly or damage.
5.º If the value resulting from the exchange of products of an order is lower or higher than the initial value of that same order, the settlement conditions will be indicated by DRT RAPID.
ARTICLE 7 – PRIVACY POLICY
The processing of your data is done in compliance with the legislation on the protection of personal data. These same data, subject to computer processing, will appear in the DRT RAPID database and are intended for the registration and presentation of other products and services, as well as institutional information.
Data supply is optional and the right of access, rectification and cancellation of any data that directly concerns you, in person or in writing, is guaranteed, under the law, directly to the address on the home page of this website.
ARTICLE 8 – JURISDICTION AND ALTERNATIVE DISPUTE RESOLUTION
1.º Except for mandatory legal provisions in matters of territorial jurisdiction, the parties agree to establish as competent the jurisdiction of the District of Leiria, with express waiver of any other, to settle any disputes arising from the performance of this Agreement.
2.º In the event of a consumer dispute, for the purposes of article 18 of Law no. 144/2015, of 8th September, the User may use the Arbitration Center contained in the List of Centers available on the website Directorate-General for Consumers at www.consumidor.gov.pt.
3.º Without prejudice to what is mentioned in the previous number, the User can present his Complaint to DRT RAPID, in the Physical Complaints Book available at the DRT Headquarters, or through the Electronic Complaints Book, available at https://www.livroreclamacoes.pt/inicio.
